Commercial Building Surveys

Commercial building surveys are undertaken for a wide variety of commercial properties, including office, retail and industrial, and specialist surveys for the leisure sector including public houses, restaurants, hotels, guest houses and holiday flats.  Schedules of Dilapidations & Schedules of Condition Pursuant to Section 146 of the Law of Property Act 1925 also form part of our commercial service.

Lease Renewals and Rent Reviews

We act for a wide range of institutional and private clients.  We maintain detailed records and pride ourselves in having sound knowledge of local markets.  Following initial advice, our rent review surveyors would attempt to reach agreement by negotiation in the first instance.  We are, however, able to produce Expert Reports and act as Expert Witnesses at Court hearings, or provide evidence for submission to independent Experts, Arbitrators and Mediators.


If you have just moved into new premises and and consider the Rateable Value Assessment is too high, our specialist valuers can advise on whether or not to make a proposal to alter the Rating List.  We will advise on your rights and if necessary carry an appeal right through to the Valuation Tribunal.  

We will also happily advise on transitional relief, small business rate relief and empty rates thresholds.

Dispute Resolution

We have senior surveyors who act as Expert Witnesses, each with particular experience and expertise in specialist areas of valuation survey, building/construction disputes, commercial / residential leisure sector and other types of properties.

Party Wall Act

The Party Wall Act 1996 refers to the rights and responsibility of owners each side of the dividing wall or floor.  Our specialist surveyors will provide advice on owners rights and service of notices in relation to intention to carry out works; this is to ensure that the party carrying out the works proceeds to do so reasonably and with due care and that the interests of the affected neighbour are safeguarded.

Specialist advice should be sought ideally before works commence.

Leasehold Enfranchisement Division

Our specialist valuers will provide advice to leaseholders of houses under the provisions of the Leasehold Reform Act 1967 and also to individual flat owners wishing to extend their leases by 90 years under the provisions of the Leasehold Reform, Housing and Urban Development Act 1993.  Advice is also provided for the collective enfranchisement process where leaseholders of blocks of flats intend to purchase the freehold interest.  Our specialist valuers will firstly advise on the value of the interest involved and the amounts to be paid in negotiation.  They will act on behalf of clients to negotiate terms and if necessary represent parties at the Leasehold Valuation Tribunal.

Commercial and Residential Energy Performance Certificates

Irvine Nott LLP have been advising and undertaking residential and commercial EPC's for Local Authorities, public companies and private clients throughout the Westcountry.  From 1st July 2011 all commercial premises on the market will require an EPC to have been commissioned.

The changes extend the current requirements to commission an EPC that apply to residential buildings to all buildings sold or rented out.  In general, the onus remains on the "relevant person" i.e. the seller or landlord to commission an EPC before marketing.  The amendments to the Energy Performance of Buildings Regulations require the EPC to be attached to written particulars in relation to all buildings sold or rented out, including commercial.

Our in-house Assessor will gladly advise on these changes and provide a competitive quotation.

Residential Survey & Valuation

Our Department covers a wide range of surveys and valuations, including full building surveys, homebuyer surveys, including the new RICS Homebuyer Report.  Residential valuations are also undertaken for probate, taxation, insurance and family purposes.
